Terms of Use for the Website www.al-amar.bg

These General Terms and Conditions govern the relationship between ASM-GROUP Ltd. (hereinafter referred to as “Merchant”) on the one hand, and the users of the website and services available at http://www.al-amar.bg (hereinafter referred to as “Users”) on the other hand.

Please read these Terms and Conditions carefully before using the information and commercial services provided on the Site (hereinafter referred to as “Services”).

This document contains information about ASM-GROUP Ltd.'s activities and the general terms for using the services provided by www.al-amar.bg, regulating the relationship between the Merchant and each of its Users.

Acceptance of these Terms is a necessary and mandatory condition for concluding a contract between the User and the Merchant.

By accepting the Terms, the User agrees to the processing of their personal data on the basis of the contract concluded between them and the Merchant.


Definitions

For the purposes of these Terms and Conditions, the following terms shall have the meaning below:

  • Sitewww.al-amar.bg and all its subpages.

  • User – any natural person who acquires goods or uses services not intended for commercial or professional activity, and any natural person acting outside the scope of their commercial or professional activity under a contract under this law.

  • General Terms – these Terms and Conditions, including terms of use, cookies, registration rules, delivery rules, alternative dispute resolution procedures, forms for contract withdrawal and replacement, and any other legally relevant information available on the Site.

  • Personal Data – information about a natural person that reveals their physical, psychological, mental, family, economic, cultural, or social identity.

  • Goods – movable tangible items, excluding items sold under enforcement or other measures by legally authorized bodies, as well as abandoned or state-confiscated items offered for sale by state authorities. Goods also include water, gas, and electricity when offered for sale in limited packaging or quantity.

  • Sales Contract – a contract under which the Merchant transfers or undertakes to transfer ownership of goods to the User, and the User pays or undertakes to pay the price for them, including contracts involving both goods and services.

  • Alternative Consumer Dispute Resolution Procedure – an out-of-court procedure for resolving consumer disputes, compliant with applicable law and conducted by an authorized body for alternative dispute resolution.


Provided Services

  1. On the Site, Users can enter into contracts for the purchase and sale of goods offered by the Merchant.


Orders

  1. Users use the website interface to enter into contracts with the Merchant for the offered goods.

2.1. A sales contract is considered concluded upon confirmation by the Merchant via email.

2.2. In the absence of availability of a particular product, the Merchant reserves the right to refuse the order.

2.3. After selecting one or more goods offered on the Merchant’s website, the User must add them to their shopping cart.

2.4. The User must provide delivery information and select the method and timing of payment, then confirm the order via the website interface.

2.5. Upon placing an order, the User receives an email confirmation that the order has been accepted.

  1. The Merchant has the right to refuse to conclude a contract with a non-compliant User.

3.1. The Merchant may consider a User non-compliant if:

  • The User violates the General Terms;

  • The User exhibits rude or inappropriate behavior towards the Merchant’s representatives;

  • Systematic abuses by the User against the Merchant are established.


Prices

  1. Prices of goods are those indicated on the Merchant’s website at the time of the order, except in cases of obvious error.

4.1. Prices include VAT where applicable.

  1. The Merchant reserves the right to change prices at any time without notice; such changes do not affect already placed orders.

  2. The Merchant may offer discounts on goods according to Bulgarian law and the Merchant’s rules. Rules for applicable discounts are displayed where the discount is shown. Discounts may take various forms (e.g., promotions, loyalty discounts, individual offers, random draws, contests, or surveys).

6.1. Different types of discounts cannot be combined for the purchase of the same product.


Payment

  1. For goods returned under the right of withdrawal, the Merchant refunds the amount actually paid, including standard delivery, but excluding return costs where provided by law.

  2. The User may pay using any method listed on the website, including:

  • Cash on delivery

  • Card payment

  1. If the User chooses courier delivery with cash on delivery, payment must be made to the courier upon receipt of the goods, including delivery charges.

  2. If the User chooses a payment method involving a third-party payment provider, the User may be bound by the terms, conditions, and fees of that third party.

  3. The Merchant is not responsible if a third-party payment method is unavailable or malfunctions due to reasons beyond the Merchant’s control.


Withdrawal and Replacement

  1. The User has the right to withdraw from the contract without stating a reason within 14 days of receiving the goods.

  2. To exercise this right, the User must clearly inform the Merchant of their decision to withdraw, specifying the goods to be returned and providing all order and delivery details.

  3. The Merchant publishes a standard withdrawal form on the website.

  4. The User may submit the form electronically or any other clear statement. The Merchant promptly sends confirmation of receipt on a durable medium.

  5. The User must return goods at their expense with the receipt/invoice, within 14 days of exercising the right of withdrawal.

  6. Goods must be returned in their original packaging, without signs of use or damage to commercial appearance.

  7. The Merchant may delay refund until the goods are received or proof of shipment is provided, whichever occurs first.

  8. If the User fails to return the goods without notifying the Merchant or providing a valid reason, the withdrawal is considered revoked.

  9. If the Merchant has incurred costs related to the contract, they may retain or request reimbursement of such costs.

  10. The User may not withdraw if the subject of the contract is: (e.g., personalized items, perishable goods, or other exceptions under applicable law).

  11. The Merchant refunds the User for returned goods.


Warranties and Complaints

  1. The User may file a complaint for any non-conformity of goods or services with the contract/order.

  2. The Merchant is not responsible for color differences due to monitor variations.

  3. The Merchant is not responsible for natural wear and tear.

  4. Non-conformity discovered within six months of delivery is presumed to have existed at delivery unless proven otherwise.

  5. The User cannot contest conformity if they knew or should have known at the time of the contract, or if the non-conformity is due to materials provided by the User.

  6. The User may file a complaint regardless of any commercial guarantee.

29–44. Complaint procedures, replacement, refund, repair, and related rights are described, including timelines (e.g., one month for repair, 14 days for complaint submission, etc.), maintaining original warranties, and remedies (price reduction, contract cancellation, replacement).


Intellectual Property

  1. All intellectual property on the Merchant’s website (including databases) is protected under copyright law and belongs to the Merchant or authorized licensors.

  2. Unauthorized reproduction may result in claims for full compensation.

  3. Users may not reproduce, modify, delete, publish, distribute, or otherwise disclose website content unless explicitly permitted.

  4. The Merchant ensures access to Services.

  5. The Merchant may suspend access or delete materials at its discretion.


Termination and Cancellation of the Contract

  1. The Merchant may unilaterally terminate the contract if the Services are used in violation of these Terms, Bulgarian law, or generally accepted moral norms.

  2. The contract also terminates if the Merchant ceases operations or discontinues the website.

  3. Either party may cancel the contract with one week’s notice in case of breach.

  4. Written form includes email, clicking website buttons, or checking boxes.


Severability

  1. If any clause is invalid, the rest of the contract remains valid. The invalid clause is replaced by mandatory legal provisions or established practice.


Amendments to Terms

  1. The Merchant shall notify Users of any amendments within 7 days via email.

  2. Users may reject amendments without compensation or penalty by notifying the Merchant within one month.

  3. Failure to reject constitutes acceptance of amendments.


Applicable Law

  1. Unregulated matters are governed by the laws of the Republic of Bulgaria.

Alternative dispute resolution (ADR) is voluntary and out-of-court, with regional conciliation committees. The competent body for disputes with the Merchant is the General Conciliation Committee, Sofia.
